Detailers — Premium Auto Detailing Marketplace

1. Agreement to Terms

By creating an account or using the Detailers mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Detailers reserves the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Description of Service

Detailers is a marketplace platform that connects vehicle owners ("Customers") with independent auto detailing professionals ("Detailers"). Detailers does not perform detailing services directly. Detailers are independent contractors, not employees of the platform. The platform facilitates booking, communication, payment processing, and review services between Customers and Detailers.

3. Account Registration

You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Detailers immediately of any unauthorized use of your account. One person may not maintain more than one account.

4. Booking and Payment

All bookings made through the App are binding agreements between the Customer and the Detailer. The service price displayed at checkout includes the base service price plus a 5% service fee charged by the platform. You authorize Detailers to charge your payment method for the total amount upon service completion. Prices are set by individual Detailers and may vary. Cancellations must be made at least 24 hours before the scheduled service time. Late cancellations (less than 24 hours) may be subject to a cancellation fee of up to 50% of the service price.

5. Rewards and Loyalty Program

The Detailers Rewards Program allows Customers to earn points on qualifying purchases. Points are earned at a rate of $1 = 1 point, multiplied by the Customer's tier multiplier. Points can be redeemed for discounts at a rate of 200 points = $5 off, up to 50% of the subtotal per transaction. Points expire 6 months after they are earned. Customer tiers (Member, Silver, Gold, Platinum) are based on booking activity within a rolling 3-month period. Detailers reserves the right to modify the Rewards Program, including point values, earning rates, and redemption rates, at any time with reasonable notice.

6. Platform Integrity (Anti-Circumvention)

You agree not to use the platform to arrange services outside of the Detailers App. This includes but is not limited to: exchanging personal contact information (phone numbers, email addresses, social media handles) through the in-app chat for the purpose of arranging services outside the platform; soliciting or accepting payment outside of the Detailers payment system; encouraging a Detailer or Customer to conduct future transactions outside the platform.

Violation of this policy may result in: first offense — written warning; second offense — temporary suspension of account (30 days); third offense — permanent account termination.

The in-app chat system filters and blocks attempts to share contact information. This is for the protection of both parties and to ensure all transactions benefit from the platform's satisfaction guarantee, damage protection, and dispute resolution services.

7. Reviews and Ratings

After each completed service, Customers may leave a rating (1-5 stars) and written review for the Detailer. Reviews must be honest, factual, and based on the actual service experience. Fraudulent, defamatory, or manipulated reviews are prohibited and may result in account suspension. Detailers reserves the right to remove reviews that violate these guidelines.

8. Platform Role and Disclaimer

IMPORTANT: Detailers is a technology platform that connects Customers with independent Detailing professionals. Detailers does NOT perform, supervise, direct, or control any detailing services. Detailers is not a party to any service agreement between a Customer and a Detailer.

By using the App, you acknowledge and agree that:

Detailers does not employ, manage, or supervise any Detailer on the platform. Detailers is not responsible for the quality, safety, legality, or timeliness of services performed by any Detailer. Detailers is not liable for any damage to vehicles, property, or personal belongings caused by a Detailer during or as a result of any service. Detailers is not liable for any personal injury, theft, criminal activity, negligence, or misconduct committed by any Detailer. Detailers does not guarantee the accuracy of any Detailer's profile information, certifications, insurance, or qualifications. Detailers makes no warranty, express or implied, regarding the fitness or suitability of any Detailer for any particular service.

The use of the term "Booking Protection" in the App refers to the platform's dispute resolution process and does not constitute an insurance policy, warranty, or guarantee of any kind. All services are performed at the Customer's own risk.

BIOHAZARD AND HAZARDOUS MATERIALS DISCLAIMER: The Detailers platform is designed exclusively for standard automotive detailing services. The platform is NOT designed for, and does not facilitate, the cleanup or handling of biohazardous materials, including but not limited to: blood, bodily fluids, human or animal remains, crime scene residue, chemical spills, mold contamination, or any material classified as hazardous under federal, state, or local regulations. If a Customer requests or a Detailer voluntarily performs any service involving biohazardous or hazardous materials, such service is performed entirely outside the scope of the Detailers platform and at the sole risk and liability of the parties involved. Detailers (the platform) assumes no responsibility, liability, or obligation whatsoever for any injury, illness, contamination, legal consequence, or damage arising from the handling of biohazardous or hazardous materials. Such services may require specialized licensing, training, and protective equipment that standard auto detailers do not possess.

9. Independent Contractors

Detailers on the platform are independent contractors and not employees, agents, representatives, or partners of Detailers (the platform). The platform does not control the manner, method, tools, or schedule by which Detailers perform their services.

Each Detailer is solely responsible for: the quality and outcome of their work; their own tools, products, supplies, and equipment; maintaining appropriate business licenses and insurance as required by their jurisdiction; compliance with all applicable local, state, and federal laws; their own tax obligations including income tax, self-employment tax, and any applicable sales tax; their own immigration and work authorization status.

Detailers (the platform) is a digital technology platform that provides a marketplace connecting third parties. The platform does NOT employ any Detailer. Detailers (the platform) does not verify, sponsor, or assume any responsibility for the immigration status, work authorization, citizenship, or legal right to work of any Detailer or any user on the platform. Each Detailer represents and warrants that they are legally authorized to perform services in their jurisdiction and that their use of the platform complies with all applicable immigration and employment laws.

Detailers (the platform) has no obligation to verify or validate any Detailer's insurance coverage, business licensing, professional qualifications, immigration status, or work authorization. Customers are encouraged to request proof of insurance from their Detailer before service begins.

10. Refund and Cancellation Policy

Cancellation by Customer:
More than 24 hours before scheduled service: full refund, no fee. Between 12-24 hours before: refund minus 25% cancellation fee. Less than 12 hours before: refund minus 50% cancellation fee. No-show (Customer not available at scheduled time): no refund.

Cancellation by Detailer:
If a Detailer cancels a confirmed booking, the Customer receives a full refund. Repeated cancellations by a Detailer result in tier demotion and potential suspension.

Service Quality Disputes:
If a Customer is dissatisfied with the quality of service, they may submit a dispute through the App within 48 hours of service completion. Detailers (the platform) will review the dispute and may, at its sole discretion, offer a partial refund, facilitate a redo with the same Detailer, or facilitate a redo with a different Detailer at no additional cost. Refunds for service quality disputes are capped at the service price paid (excluding service fees). Detailers (the platform) is under no obligation to issue a refund and each case is evaluated individually.

Refund Processing:
Approved refunds are processed within 5-10 business days to the original payment method. Service fees (5%) are non-refundable except in cases of Detailer cancellation or platform error.

No Refunds:
Refunds are not available for: services that have been fully completed and accepted by the Customer; disputes filed more than 48 hours after service completion; issues arising from inaccurate information provided by the Customer (wrong address, vehicle size, etc.); damage claims not reported within 24 hours of service completion.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Detailers provides the platform on an "as is" and "as available" basis without warranties of any kind, express or implied. Detailers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: the use or inability to use the App; any service performed or not performed by any Detailer; any damage to vehicles, property, or personal belongings; any personal injury or harm; any loss of data or business interruption; any unauthorized access to your account; any conduct of any third party on the platform.

Detailers' total aggregate liability for all claims arising from or related to the App or any service booked through the App shall not exceed the lesser of: (a) the amount paid by you through the platform in the 6 months preceding the claim, or (b) $500.

You acknowledge that this limitation of liability is a fundamental element of the agreement between you and Detailers, and that the platform would not be provided without such limitations.

12. Indemnification

You agree to indemnify, defend, and hold harmless Detailers, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of the App; any service you receive through the App; your violation of these Terms; your violation of any third party's rights; any dispute between you and a Detailer.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the data practices described in the Privacy Policy.

14. Termination

Detailers reserves the right to suspend or terminate your account at any time for violation of these Terms or for any reason at its sole discretion. Upon termination, your right to use the App ceases immediately. Any earned but unredeemed rewards points will be forfeited upon account termination for policy violations.

15. Dispute Resolution

Any disputes arising from or related to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Broward County, Florida. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

16. Force Majeure

Detailers shall not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure results from events beyond its reasonable control, including but not limited to: natural disasters, pandemics or public health emergencies, acts of terrorism or war, government orders or restrictions, power outages or telecommunications failures, labor disputes or strikes, civil unrest, or any other force majeure event. In the event of such occurrence, affected bookings may be cancelled without penalty to either party, and any prepaid amounts shall be refunded in full.

17. Electronic Communications Consent

By creating an account on the Detailers App, you consent to receive electronic communications from Detailers, including but not limited to: booking confirmations, updates, and reminders; service notifications and status updates; promotional offers and marketing messages; account and security alerts; rewards program updates; platform updates and policy changes.

You agree that all agreements, notices, disclosures, and other communications that Detailers provides to you electronically satisfy any legal requirement that such communications be in writing, in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. 7001 et seq.).

You may opt out of promotional and marketing communications at any time through the App settings or by following the unsubscribe instructions in any email. However, you may not opt out of transactional communications related to your account, bookings, or payments while your account is active.

18. Intellectual Property

All content, features, and functionality of the Detailers App — including but not limited to the software, source code, design, text, graphics, logos, icons, trademarks, service marks, and the overall look and feel — are the exclusive property of Detailers and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or create derivative works from any part of the App without prior written consent from Detailers.

User-Generated Content: By submitting reviews, ratings, photos, or other content through the App, you grant Detailers a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute such content for any purpose, including marketing and promotional materials. You represent that you own or have the rights to submit such content and that it does not violate any third party's rights.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
